Proclamation of Emergency in Pakistan Violates Oath of Office By President Musharraf

Musharraf’s Address Confesses Failure on all Fronts after 7 years in Power

AIMMM Hopes for Restoration of Constitutional Democracy and Elected Government

New Delhi : 5 November, 2007 : Syed Shahabuddin, Presient All India Muslim Majlis-e-Mushawarat, has issued the following statement;

‘The AIMMM deeply deplores the suspension of the Constitution and the imposition of Emergency in Pakistan by General Musharraf, heralded by an attack on the dignity, integrity and independence of the Judiciary. The Supreme Court was occupied by the Army and the Chief Justice and several other judges, who had immediately declared the Emergency as unconstitutional, were forced out at gun-point. Subsequently, many senior advocates, political leaders and human rights activitists nearly 500 have been arrested.

The AIMMM deeply deplores the suspension of the Constitution and the imposition of Emergency in Pakistan by General Musharraf, heralded by an attack on the dignity, integrity and independence of the Judiciary. The Supreme Court was occupied by the Army and the Chief Justice and several other judges, who had immediately declared the Emergency as unconstitutional, were forced out at gun-point. Subsequently, many senior advocates, political leaders and human rights activitists nearly 500 have been arrested.

The AIMMM regards the Proclamation of Emergency as a violation of the oath of office taken by General Musharraf when he became the President under the Constitution.

The AIMMM sees General Musharraf’s Address to the Nation a confession of failure on all fronts. Since he has held power for 7 years, he is himself responsible for upsurge in terrorism, rebellion and militancy, demoralization in the Army and the police, economic stagnation and raging social conflicts.

The AIMMM sees the object and purpose behind the army rule as purely personal, to save General Musharraf from the Supreme Court’s imminent rulings, declaring his 6 October election in uniform as null & void and barring a third term for him.

If his charges against the Judiciary of excessive judicial activism and undue interference in the Executive and the Legislature are correct, the only course open to him was constitutional amendment and legislation by the National Assembly, and not military take-over which is, in one sense, unprecedented in the history of Pakistan.

The AIMMM also feels that in declaring himself as the self appointed saviour of Pakistan, General Musharraf has only repeated the classical excuse and traditional refrain of all those who have seized power illegally down the ages.

The AIMMM hopes that the Emergency shall be lifted soon and democracy shall be peacefully restored, to give the people of Pakistan a government of their choice.’
